1. General Provisions.
These Terms and Conditions of Sale and Purchase (the "Terms") are a legally binding document which sets out the rights, obligations and responsibilities between the Buyer ("You") and the Seller ("We") in relation to the purchase of goods by You in the online shop (the "E-Shop").
2. The moment of conclusion of the contract of sale and purchase.
2.1 The contract between You and Us shall be deemed to have been concluded from the moment You click on the "Order" button in the e-shop, after having created a shopping cart, indicated the delivery address, chosen the payment method and read Our Rules.
2.2 The Contract shall commence when We receive Your payment for the Goods within 3 (three) working days and shall remain in force until the Goods have been fully delivered.
2.2.1. In the Shop, payment is made in advance only, using only the Paysera system - for the time being only the e-banking options and cash operators operated by Paysera.
2.2.2 Bank cards are not yet accepted.
2.3 Every contract concluded between Us and You is stored in the e-shop.
2.4 The order sent and printed by e-mail is a preliminary invoice against which payment is made.
3. Your rights:
3.1 You have the right to purchase goods in the e-shop in accordance with these terms and conditions and the e-shop.
3.2 You have the right to withdraw from the contract for the purchase of goods with the e-shop, except in cases where the contract is concluded for:
3.2.1. participation in games or lotteries;
3.2.2. in other cases where the contract of sale and purchase cannot be withdrawn, in accordance with the laws of the Republic of Lithuania.
4. You undertake to:
4.1. you are obliged to pay for the goods within 3 (three) working days from the placing of the order and to accept them, unless otherwise agreed.
4.2 If the details provided on your registration form change, you must update them immediately.
4.3 By using the e-shop, you agree to these Terms and Conditions of Sale and Purchase and must comply with them.
5. Our Rights:
5.1 If the Buyer attempts to interfere with the operation or stable functioning of the e-shop, We may, without prior notice, restrict or suspend the Buyer's access to the e-shop or, in exceptional cases, cancel the Buyer's registration.
5.2 We may, in important circumstances, temporarily or permanently suspend the operation of the e-shop without prior notice to You.
5.3 We may unilaterally change the terms and conditions of these Terms.
6. We undertake:
6.1. to provide you with all the conditions for the proper use of the e-shop services.
6.2 Deliver the goods you have ordered to the address you have specified and within the agreed delivery period.
6.3 In the event of important circumstances where we are unable to deliver the goods you have ordered, we undertake to offer you an equivalent product and, in the event that you refuse to accept an equivalent product, to refund your money within 72 hours.
7. Delivery:
7.1 The Goods shall be delivered by Us or Our authorised representative.
7.2 At the time of delivery of the Goods, You must inspect the condition of the consignment (the condition of the outer packaging and the condition of ALL individual product boxes inside and the protective holograms on them) with Us or Our authorised representative.
7.3 Once You have signed the Invoice or the delivery document, the Consignment shall be deemed to have been delivered.
7.4 If you notice any damage to the Consignment (e.g. damage to the outer packaging of the Consignment and/or to at least one of the inner product boxes and/or the protective holograms on the inner product boxes), you must not accept the Consignment and you must note this on the consignment note. Once you have accepted the goods and signed the consignment note without remarks, the consignment shall be deemed to have been delivered in good order.
8. Returning the Goods.
8.1 Goods shall only be returned in the cases specified:
8.1.1. when goods not ordered by you are delivered to you
8.1.2. when a damaged parcel is delivered to you (e.g. damage to the outer packaging of the parcel and/or damage to the packaging of the goods and/or the protective holograms on the parcel) and you have indicated this on the consignment note
8.2. the returned goods must be fully complete. You are responsible for the complete assembly and packaging of the goods. If the Goods are not complete and properly packed, We or Our agent will not accept the Goods for return.
8.3 Goods must be returned in the packaging in which they were delivered. The packaging of the Goods (the metallized paper box and the protective holograms on it) must be undamaged, clean, properly prepared and packed in the shipping carton, except as provided in clause 8.1.2.
8.5 Where Goods are returned for the reasons set out in clause 8.1, We undertake to collect the Goods and replace them with Goods corresponding to the order. In the event that We do not have the required item, We will refund the money You have paid for the item.
8.6 If it is found that the returned goods do not comply with paragraph 8.1, the returned goods shall not be accepted.
8.7 Returning the Goods consists of the following steps:
8.7.1. the Buyer completes the online return form and sends it to the e-shop
8.7.2. the e-shop verifies the details of the return form received and, if they meet the return conditions, sends the Buyer a confirmation
8.7.3. the e-shop, through its representatives, accepts the returned product and exchanges it for a suitable product or refunds the money to the Buyer within 14 calendar days
9. Liability.
9.1 You are fully responsible for the accuracy of the data provided in the registration form. If You do not provide accurate details on the registration form, We shall not be liable for any consequences arising therefrom.
9.2 You are responsible for the actions you take when using the e-shop.
9.3 You are responsible for the transmission of the identification code to third parties. If third parties use your identification code, you are responsible for the actions performed by the third party.
10. Transmission of information.
10.1 We will send all communications to the email address provided in your registration form.
10.2 You shall send all communications and questions to Us by the means indicated in the "Contact Us" section of Our e-shop.
11. Protection of personal data.
11.1 Any information relating to personal data shall be subject to the Seller's personal data protection policy, which is governed by the relevant Laws of the Republic of Lithuania and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the "General Data Protection Regulation"), and which shall be implemented in accordance with the recommendations of the National Data Protection Inspectorate.
11.2 The Seller shall not transfer (except in accordance with the procedure provided for by the Laws of the Republic of Lithuania and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation)) the Buyer's personal data to third parties, except to persons contributing to the execution of the order, for whom the data is necessary for the successful execution of the order (e.g. postal couriers).
12. Final provisions.
12.1 The dissemination of any information from the e-shop without the written consent of the Seller is prohibited.
12.2 These Terms and Conditions are governed by the law of the Republic of Lithuania.
12.3 All disagreements arising out of the application of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedures established by the laws of the Republic of Lithuania.
